Booking and course participation terms and conditions. These terms and conditions represent an agreement between the University Court of the University of Edinburgh (the "University") and you. By accepting the University's offer of a place on your course(s), you accept these terms and conditions in full, which along with your offer and the University's relevant rules, regulations, policies and procedures (including IT and health and safety regulations), form the contract between you and the University in relation to your course at the Centre for Open Learning ("COL"). Enrolment Process, Payment and FeesApplications are only accepted via our online application form.Your application will not be considered if you do not provide all applicable information and supporting documents requested during the application process.You must evidence that you meet all applicable application criteria for your chosen course(s), otherwise your application may be declined.Applications must be made before the advertised application deadline for your chosen course(s). COL is under no obligation to accept applications after the deadline.Payment of fees must be made upon request and within required timescales, otherwise your application may be declined and you may not be permitted to continue your course(s).Upon providing payment, you enter into a contract with COL and confirm that you wish to accept the offer of a place on your chosen course(s). Cancellations and Refunds - Student CancellationsOnce you have made payment to COL as part of the enrolment process and we have provided you with a booking confirmation, you are deemed to have a contract with COL. You have the right to cancel this contract with us. The cancellation period will expire at the end of 14 days after you have made payment, at which point there is no automatic right to cancel and obtain a refund.In the event that you wish to cancel or amend your course place, fees will be refunded on the following basis: Date of Withdrawal Within 14 days of COL receiving your payment and providing a booking confirmationFee RefundWe will refund all fees paid by you.Date of Withdrawal After 14 days of COL receiving your payment and providing a booking confirmationDate of Withdrawal No refund will be made for any fees paid by you. You will lose your right to cancel if you have completed/part completed the course during the cancellation period.COL may consider refund requests out-with the 14-day cancellation period where you can demonstrate extenuating personal circumstances which prohibit you from continuing your course(s), such as serious illness or bereavement. We will review such requests on a case-by-case basis, and reserve the right to ask for supporting evidence.You must inform us of your decision to cancel in a clear statement by sending an email to: col.admissions@ed.ac.uk Cancellations and Refunds - Cancellation by UsCOL's liability when it cancels a course will be limited to a refund of the course fee only, in accordance with this section.We may cancel your course(s) if we fail to recruit minimum enrolments numbers as applicable, or if circumstances beyond our reasonable control prevent us from delivering it.If you have been offered placement on your chosen course(s) at the time of cancellation, we will offer you a refund in full for the course fee paid by you. Refund ProcessingWe will contact you if a refund is due, and may request details from you to enable us to process the payment.Once we have the details, we need to process the refund, reimbursements to you will be made using the following method: Original Payment Method: Credit/debit card Reimbursement Method:Same card as payment, unless the card has expired, in which case BACS After we begin processing the refund, the funds will normally reach you within 3-5 working days. Please be aware however, that due to factors beyond COL's control it may take up to 3 weeksin some circumstances.If we contact you requesting additional details to enable us to process a refund, and you do not provide the details within 6 months from the date we request them, you will lose the right to claim the refund. Right to Make Necessary AlterationsWhile every effort has been made to ensure that courses and activities run as advertised, COL reserves the right to make any necessary alterations or cancellations. Any such changes will be in accordance with section 11 of the University's terms and conditions of admissions. Additional Course MaterialsThe course fee does not include additional materials, books, digital equipment, etc. Please check course details on our website for the most up to date information regarding additional materials that may be required. Course ContentThe copyright and other intellectual property rights in relation to course content/materials remain the sole and exclusive property of the University of Edinburgh {or, in some cases, the relevant copyright holder). In attending the course, you agree that you will not copy or permit to be copied any of the course content/materials, nor disclose or permit the disclosure, sell or otherwise pass on those content/materials to others, unless agreed otherwise in writing with COL. Dignity and Respect and Code of Student ConductBy enrolling on your course(s), you will be required to comply with the University's Dignity and Respect Policy.In addition, as a student of the University of Edinburgh, you will be required to comply with all relevant sections of the Code of Student Conduct. If you breach any of the applicable terms set out in the policies, then you may be withdrawn from your course(s). Privacy PolicyThe University of Edinburgh holds information about everyone who applies to the University and everyone who studies at the University. We disclose information about credit students to your funding body if appropriate, and to governing agencies such as the Higher Education Statistics Agency {HESA). Following your booking, we use the information provided to: administer your studies; monitor your performance and attendance; provide you with support to fulfilour public task; maintain our IT systems; and develop our strategic plan. More details are available at:View the University of Edinburgh's Complaint Handling Policy here > GeneralThe terms of the Contract shall only be enforceable by you and the University.The Contract constitutes the entire agreement between you and the University in relation to its subject matter.The University shall not be liable for failure to perform any obligations under the Contract if such failure is caused by any act or event beyond the University's reasonable control including acts of God, war, terrorism, industrial disputes (including disputes involving the University's employees), fire, flood, storm and national emergencies ("Force Majeure Event"). If the University is the subject of a Force Majeure Event, it will take all reasonable steps to minimise the disruption to your course.No failure or delay by the University or you to exercise any right or remedy provided under the Contract or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the exercise of that or any other right or remedy.If any provision or part-provision of the Contract is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted.
